Terms and Conditions

These terms and conditions (the contract) set out your commitment to Ashcombe Park and its obligations to you when you book an event/stay through Consall Valley Leisure. Consall Valley Leisure negotiate, facilitate and conclude contracts on behalf of the venue as its Agent.

The Named Lead Booker will be responsible on behalf of their guests for meeting all obligations hereunder.

Agency

Consall Valley Leisure hereinafter ‘Consall’ acts as agent for the above venue in relation to this contract. This contract, although issued on behalf of the venue by Consall, is entered into you direct with the venue. This means that the venue accepts direct responsibility under these terms for its commitments to you, including responsibility for Consall activities as agent hereunder and you accept that you shall have no claim against Consall in relation to this contract.

Making a booking

You must check the hire invoice and booking agreement as well as all other documents we send you carefully, as soon as you receive them. If any information appearing on any document appears to be inaccurate in any way, you must let us know straight away. We regret we cannot accept any liability to make any changes if we are not notified of any inaccuracy in any document within 10 days of receipt. The usual check-in time 4pm (subject to unavoidable delays) and check-out time is 10am. Prices include VAT (where applicable) at the rates applicable at the time of printing and are subject to change if the rates or application of tax changes. In the event of a change in the rate of VAT during the course of the year, your holiday will be invoiced at the new rates of VAT unless you have already taken your holiday or paid the balance in full prior to the date of the change.

We reserve the right to alter prices in our brochure or on the website, which may vary. We will advise you of the current price at the time of booking. The Terms and Conditions for bookings may change from time to time. Please check at the time of booking.

Numbers in your party

The total number in your party must not exceed the capacity of the accommodation as advertised by us or exceed the capacity declared upon booking, without prior arrangement. Babies under the age of 2 will not be counted as members of your party. You should check the policy of your chosen accommodation carefully before booking.

Payment

A booking/reservation is confirmed upon receipt of a 25% non-refundable deposit. You will receive an invoice for the event you have booked. Your balance will be due and payable 6 weeks before arrival. For bookings made within 6 weeks of your holiday start date, you are required to pay the full amount when making the booking. If the deposit and/or balance is not paid on time, we may cancel your booking.

If you think Consall have made an error, you must notify us immediately, a revised invoice will be sent which must be paid.

The Full cost does not include the following: Drinks, Food, Catering & Transport.

Cancellations & Exclusions (of person) by Consall

Any cancellations made by the client for whatever reason shall be communicated to us by email. On receipt of notice of cancellation, Consall will seek to re-let the property for the period of the booking.

If Consall succeeds in reletting the property for the whole period it shall refund all the monies paid less the initial deposit which is non-refundable. If Consall is unable to re-let the property, the client still remains responsible for the balance.

Should a directive from the UK Government be in place during the hire period a mutual agreed date or credit will take place in order to arrange to transfer the booking to the agreed mutual date. The client still remains responsible for the balance to be paid by the due date in order for the transfer of dates to take place.

Consall strongly recommends Clients take out their own holiday cancellation insurance.

In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made. 

In the following circumstances, Consall will be entitled to prohibit members of your party from staying on-site, without obligation to refund the price or to pay any losses or costs suffered as a direct or indirect result.

  • If a member of your party is acting in an unsafe or irresponsible manner

  • If Consall or the estate has reasonable grounds that a member of your party is under the influence of drink or drugs

  • If a member of your party is likely to cause damage to property

  • If a member of your party acts in a verbal or physical threatening manner to any representative of Ashcombe

  • If any illegal activity is being conducted on the premises.

  • Or any reason we deem unreasonable.

Health and Safety

  • Guests should comply with all instructions given by Ashcombe staff.

  • Pools/ponds – Guests must not enter the pools/ponds. Children must be supervised at all times in the pool/pond area.

  • Grounds at Ashcombe Park are used at guests own risk.

Kitchen

  • Equipment is used at guests own risk and should not be used unless trained to do so.

  • Children are not allowed in this area at any time.

  • Spillages should be cleaned up asap.

  • All equipment should be examined before use for faults. If equipment is found to be faulty, do not use it and report to a member of the Consall team.

  • The supervision of children, babies, and any adults requiring care remains the responsibility of the guest at all times.

  • Games provided by Ashcombe Park are used at guests own risk.

  • If alcohol is consumed on the premises this is done completely at the guest's own risk.

Security Deposits

You will be asked for an additional £1000 security deposit. This is payable before your arrival and will be returned to you post your departure, provided that your accommodation is undamaged, clean, and tidy. A further security deposit will be applicable if extra guests are invited on-site for a function for example a wedding or a party.

Breakages or Damage to Accommodation

The Client is bound to reimburse Ashcombe Park for damage caused in the accommodation during the period of hire. A security deposit may not be refunded to accommodate for replacement, repair or extra cleaning costs. If the cost of replacement, repair or extra cleaning is greater than the security deposit the named lead booker is liable for the additional amount.

In the event of any loss of any keys belonging to Consall Valley, you will incur a replacement charge of £38.00 per key.

Smoking 

Smoking is strictly forbidden in any area at Ashcombe Park the only exception being the designated smoking area. This includes e-cigarettes. If smoking is detected a charge may be made to cover the extra cleaning service required to eliminate any smells/damage/mess discovered.

Rights of Entry 

Consall reserve the right to enter accommodation at all times, for purposes of inspection or to carry out any necessary repairs/maintenance or in the case of an emergency. 

Wi-Fi and Appropriate usage policy 

Guests should accept to use the access to the internet fairly and appropriately. We reserve the right to monitor network performance and user usage in order to maintain a fair and high level of service to all our guests.

The internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video/music/media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads/uploads. Access to illegal activity or use of our network for illegal activity is prohibited and will be reported to local authorities.

External Service providers

  • Consall should always be informed when bringing service providers onto the site.

  • All service providers should provide Consall proof of public liability insurance.

  • Clients are liable for any damage caused by external suppliers.

  • Consall reserve the right to impose a charge for external suppliers.

Swimming pool/hot tubs

  • Extra charges will apply for swimming pools/hot tubs to cover the extra electricity/ water used.

  • Clients are responsible for equipment and health and safety relating to hot tubs/pools.

  • Consall takes no liability for external providers.

External Caterers 

  • Clients are encouraged to use caterers from Ashcombe Parks recommended caterers list as we have all their documentation.

  • If you require to use other caterers, it is by Ashcombe Parks discretion and must adhere to Ashcombes terms and conditions.

  • A charge will be applicable if not using recommended caterers.

  • Caterers will have to provide method statements, proof of PAT testing of equipment, proof of food hygiene certificate.

  • Clients are responsible for making sure external caterers leave the kitchen in a satisfactory state.

Accuracy

We have taken care to ensure the accuracy at the time of publication of any brochure and continuously with the website, however, information and prices may have changed by the time you book. There may be small differences between the actual accommodation and facilities and its description, as we are always looking for ways to make improvements. We will use our best endeavours to notify you of any changes to, or inaccuracies, as soon as reasonably practical after we become aware of that change or inaccuracy.

Tenant’s Obligations

The tenant agrees:

  • Not to exceed the maximum number of persons agreed in the booking

  • To ensure that only the members of the party mentioned on the booking agreement occupy the property for holiday purposes only

  • Not to sub-let the property or any part of the property

  • To keep the property clean and in good order and be responsible for any breakages

  • Not to cause annoyance or become a nuisance to occupants of adjoining properties

  • To notify Consall if your departure from the property is prior to the end of the hire period in order that we may ensure that the property is secure.

  • To ensure any visiting guests leave the property before 12.30 am in an orderly manner

  • All accidents should be reported to Ashcombe Park staff and the accident book filled out.

Gate Code 

The gate code should only be shared with guests of Ashcombe Park.

Force Majeure

Circumstances amounting to “force majeure” include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of your accommodation (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, explosion, flood, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic and all similar situations beyond the Owners control.

Security Cameras 

Security cameras are present in the outside and entrance areas. The Cameras are used for security purposes only and all data is compliant with General Data Protection Regulations. 

Liability

Except in the case of liability for death or personal injury caused by Consall’s proven negligence Consall will not be liable for any personal injury losses or damage suffered by you or your possessions for whatever reason which may have occurred in the course of, or as a result of, the day(s).

For the avoidance of doubt Consall’s liability for personal injury, death, fraud or fraudulent misrepresentation shall not be excluded, however, Consall shall not be liable in contract or tort for any loss, damage, or legal fees as a result of any failure in the performance of the contract by you, injury or damage suffered by you or any third party, any loss resulting from the contract with Consall (including but without limitation where Consall falls into insolvency, administration or a petition for winding up or bankruptcy is present against Consall owners the result of which may be that any payments made by you hereunder are unrecoverable) or any unusual or unforeseeable circumstances beyond Consall’s control.

Consall liability except in circumstances involving death, personal injury, fraud or fraudulent misrepresentation is limited to £10 million. Your function is entirely at your risk. The security of equipment, vehicles and other possessions is entirely the responsibility of the owner’s risk. Consall cannot accept any responsibility for the loss or damage caused. Please park in the car parks provided.

Complaints Procedure

If a Guest has a complaint, it should be submitted to the Coordinator(s) who are responsible for the management and maintenance of the property at the earliest opportunity. No complaints can be accepted unless notified immediately and during the rental period as the coordinator(s) should be given an opportunity to make good the reason for the complaint.

Law

Relevant United Kingdom law will apply to this contract.

These terms

These terms constitute the whole of the agreement between the parties (unless varied in writing) and by your signature hereto and payment of the deposit referred to in paragraph 4 above shall constitute acceptance on behalf of the event, it being the signatory’s responsibility to make other members of their party aware of these terms.

Data and protection

You agree that Consall shall be entitled to use your details and those members of your party in connection with the organising of your event/stay. Consall will not pass these details to third parties other than as necessary to arrange your event, but this may involve a credit reference check, public authorities such as customs/ immigration if required by them, or as required by law. We will not, however, pass any information onto any person not responsible for part of your accommodation and travel arrangements. This applies to any sensitive information that you give us such as details of any disabilities, or dietary/ religious requirements. If we cannot pass the information on to the relevant suppliers, we cannot provide your booking. In making this booking, you consent to this information being passed on to the relevant person. The owner or the suppliers use of your information is subject to their policy and is their responsibility. Consall may use the details to notify you of events if they think these could be of interest to you. If at any time you want to be removed from Consall’s database, please contact Consall.
